3. SHIPPING POLICY

 

For products available in the virtual store, as a rule, the deadline for sending the work or reproduction will be calculated at the time of placing the order, considering the shipping location (studio address) and the delivery location registered by the buyer at the time of ordering. purchase. In the case of original works, after confirmation of payment by the system, the studio will have up to 3 (three) business days to prepare the work for shipment. In the case of personalized work (special orders), however, the production and drying time of the painting will be duly informed in the quote sent to the contractor and will be added to the shipping time.

 

Depending on the dimensions of the work, the shipment will be carried out via post office or carrier.

The shipping cost and delivery method for special orders will be included in the quote sent to the investor.

 

Once the shipment is made, the order tracking code will be made available to the email registered at the time of purchase.

 

In some cases, the work may be sent off the chassis, rolled up in a transport tube, a situation that will be previously informed in the description of the work or in the contact with the buyer.

 

As a general rule, the buyer is responsible for paying any costs related to the shipping and receipt of the purchased work.

 

The studio is not responsible for any delays in delivery due to postal strikes or even fortuitous situations or force majeure that impact, in any way, on delivery.

 

Nor is it responsible for incomplete addresses that make delivery of the work unfeasible and/or for the cost of the second shipment, if it returns because the address was not found or in case of not being picked up by the recipient within the deadline.

 

The CORREIOS informs that deliveries may be delayed due to strikes, partial stoppage of operations, restrictions of locations or extreme situations such as heavy rains, floods, natural disasters, serious disturbances of public order or other unpredictable situations or specific to each region. In these cases, the Post Office does not compensate for delay in delivery. 

 

 

4. EXCHANGE AND RETURN POLICY

 

a) Right of repentance

 

Pursuant to article 49 of the Consumer Protection Code, the buyer has a period of 7 (seven) days, after receiving the artwork or reproduction, to regret the purchase and return it, in its packaging. originals, without having been used, accompanied by the certificate of authenticity and other documents that may have been sent along with the work. In this case, the amount will be refunded to the same buyer, CPF/CNPJ and account registered with the time of purchase, depending on the payment method (as indicated in the refund topic). Return shipping must be the same as shipping, and the buyer will be responsible for the new shipping.

 

The return will only be accepted after receipt and analysis of the conditions of the work or reproduction returned.

 

The studio reserves the right to refuse the return, once the work or reproduction has been received and examined, if evidence of use (exposure), improper handling, inadequate storage and/or intentional or accidental damage is found; if the original packaging is damaged, unusable or incomplete; and/or if there is damage to the Certificate of Authenticity and other documents sent with the order. In this case, the work or reproduction will be sent back to the client, with a report on the reasons for the refusal, with a new front at his expense.

 

In the case of a commissioned work, the investor may request all the repairs that he deems necessary from the artist until the result of the work is fully to his liking. The artist sends the photograph of the work to the investor via whatsapp or e-mail, and the investor has the right to ask for small changes in the work so that it is fully in line with what he expects. Therefore, in the case of an order, the investor has no right of regret, as he can request the modification of the work as many times as he deems necessary until he is satisfied with the final result of the work. Only after the investor is fully satisfied will the work be sent.

 

b) Transport failure or order error

 

Works or reproductions acquired through this website must be received and examined upon receipt, preferably by the purchaser himself. If the buyer cannot be present at the time of delivery, he must instruct the recipient to refuse delivery and note the justification for the refusal on the back of the Invoice or on the Delivery Form if: the package appears to be violated, damaged, perforated, cut, bending or apparent moisture under the outer plastic; the work or reproduction received is damaged or has production defects; an error is found in the order or discrepancy between the product offered and the product delivered.

 

Except in cases of damage during shipping, the order must be unpacked so as not to damage the packaging – the best place to store the works or reproductions, when they are not on display, is inside the packaging itself, in a cool, dry and ventilated. The buyer must preserve the packaging – it is essential for the safe transport of the work or reproduction and in case of return (replacement or return) it must be in perfect condition.

If the damage or error in the order is found after delivery, the buyer is still covered by the Consumer Protection Code. To do so, you must photograph the external packaging and the work, including the details of damage (damaged frame or wooden structure, fabric not intact, stained or scratched paint, etc.) and/or errors in the order and send the photos, as soon as possible. as soon as possible, to alejandroarnutti1@gmail.com , including a report on the status of the work, your name and address.

 

If the damage found is easily repairable, for example, it is possible to replace the chassis and/or the frame and/or the restoration of the painting or reproduction, it is at the buyer's discretion to request the restoration, with a proportional reduction in the price.

 

The buyer may also choose to exchange or return the work.

 

In case of return, there will be no additional cost to the buyer. Any amounts paid will be refunded to the same CPF/CNPJ and account registered at the time of purchase, depending on the payment method (as indicated in the topic about refund). Likewise, any costs arising from the return, in this case, will be duly reimbursed.

 

If the buyer chooses to replace the work, it is important to note that, in the case of original works, which are unique and exclusive, it is impossible to exchange them for another work of the same kind. There is, however, the possibility of exchanging it for another work of equivalent value.

 

In any event, the work or reproduction must be returned to the studio, in the original packaging (or similar packaging, which provides security for the piece during transport, in case the original is destroyed due to shipping damage), accompanied by the Certificate of Authenticity and the other documents sent with the order, in addition to a copy of the Delivery Form.

 

The returned piece will be examined and if any of the following situations are found, the replacement or return of the work or reproduction will not be accepted, which will be sent back to the buyer with a report on the reasons for the refusal:

- absence of the alleged defect;

- signs of use (exposure);

- indications of improper handling;

- indications of inadequate storage;

- absence of the Certificate of Authenticity and/or other documents sent with the request.

 

 

c) reimbursement

 

The refund of any amounts will be made according to the payment method chosen by the buyer.

If the payment was made with a credit card, the chargeback will be made by the card company, as a credit on the next comparator invoice. A confirmation email will be sent stating the date the credit request was forwarded to the buyer's credit card company. The term for crediting the buyer's card may vary depending on the closing date of your invoice. If the buyer does not see the respective credit on their invoice, they must contact their credit card company.

If the payment has been made with an online debit from a checking account, transfer between PAG SEGURO accounts or bank slip, the chargeback will be made in the form of a credit to the buyer's PAG SEGURO account, and the buyer may use the balance for a new purchase. or request the withdrawal of the amount to your bank account.

 

If the payment has been made by any other means, the reversal will be made by means of a deposit or bank transfer to an account registered with the buyer's CPF/CNPJ, indicated by the buyer in due course.
